It happened about 6 months ago on my way home from the land fill. There was a roadblock and they flagged me down to inspect my truck. I started off being polite and cooperating with the officer..... Untill he gave me a VI for having a legal fuel cell. I got angry. Now there were about 4 other officers on the other side of the road standing there doing nothing productive, just laughing at the show I was putting on. That was the last straw so I snapped on them and well they picked my truck apart.

-no N (at this rate I will never get rid of it)

-un necessary noise

My arguements are:

-My N fell off while unloading garbage

-When I was leaving my truck stalled so I put it to the floor to start it, it reved up. There are also large trucks constantly driving to the dump, they are much louder.


anything I should add to my case? I cannot afford to loose

N got knocked off at the dump, sounds good, very plausable. As for the too loud, did they get out the dB tester? Have you done the VI? Did you have to chage/modify anything to pass?

if they didnt get the db tester out them put stock exhaust back on the truck and say go out there and test it

no he never got out the db tester. He was just writing tickets on impulse. The inspection notice did not include the exhaust. It passed inspection a while ago, exhaust is legit.

Sounds like you can beat it.

About the N:
Make sure you say that the N could've got accidentally knocked off (not "fell" off) or say it could've been stolen prior, whatever, just mention how you placed it securely and visibly on before leaving your house.

As for the unneccessary noise:
make sure you tell the judge that the vehicles been through recent inspection with current exhaust (show receipt or such if you have it), you've had no other complaints, and that no actual dB testing was ever done. And the revving at startup due to flooding story is all good.

MVAR, Schedule to Division 7, paragraph 27:

A motor vehicle shall be equipped with an exhaust muffler which complies with section 7.03 of the regulations.

The opinion of an inspector as to whether the engine and exhaust noise is greater than that made by other vehicles in good condition of comparable size, horsepower, piston displacement or compression ratio shall determine whether exhaust gases are expelled with excessive noise.

When tested in an inspection station, the vehicle engine, any auxiliary engine and exhaust level shall not exceed Table 3 standards.

Light duty 83 DBA
Gasoline−driven heavy duty 88 DBA
Motorcycles 91 DBA
Diesel−driven heavy duty 93 DBA

This wasn't a test in an inspection station.

Yeah, dunno how often you're told this but it's really nice to have an (ex-)cop with a good head on their shoulders to help straighten things out for us. Thanks.

Just got back from court. Un necessary noise ticket got thrown out. All I have to deal with is the N ticket, that carries no points and the judge gave me until september to pay $109. The judges exact words were "you were very lucky here" I agree.

Thanks, I appreciate the compliment.

I've got to do something with what I learned over the last 25 years, and it never hurts to share. Maybe I can convince someone to be a safer driver, and that would be good for all of us!
