I finally got a court date, April 10th. Going in to fight a ticket for running a yellow light, of all the stupid bullshit tickets to get. Any advice for me? I'm probably taking my sis with, she was with me at the time. The guy actually tried telling me that I ran a red at first, which was complete bullshit. I figure that might be worth mentioning, take away some of his credibility. I still can't believe that you can actually get a ticket for going through a yellow, why even bother then??? Just go green to red. Fucking jackass.

In actuality, a yellow light at an intersection in BC means stop, unless you cannot stop in safety.
Yellow light
128. (1) When a yellow light alone is exhibited at an intersection by a traffic control signal, following the exhibition of a green light,
(a) the driver of a vehicle approaching the intersection and facing the yellow light must cause it to stop before entering the marked crosswalk on the near side of the intersection, or if there is no marked crosswalk, before entering the intersection, unless the stop cannot be made in safety,

Bud, I was driving a fully loaded work truck, in the rain, during early morning hours, at the speed limit. Which he also claimed I was not doing. I made a judgement call based on the fact that it was safer to go through a yellow light than slam on the brakes and possibly wind up in the middle of the intersection. Also, the light was yellow as far as we could see it above us. So don't make bullshit fucking assumptions. I hate cops enough already, if you guys really want to improve public perception maybe treating the people you supposedly protect and serve a little better would be a good idea.

I can't find the ticket, it stated "yellow light" on it specifically, nothing else.
Dispute, brin pics of your truck as well as weight, tire width ect. ect.

get weather conditions for that day ASAP if it was raining.

Adverse weather conditions, heavy load, and it appears difficulty in determining whether you ran the yellow or the red.
Maybe the speed limit was too fast for the circumstances?
What you really want to make sure of is the timing of the light phases. It's not impossible that the yellow phase was too short for the speed limit. Then perhaps you would have an argument that would fly...

Adverse weather conditions, which I cannot control. Heavy load, which I also could not control, my dad was on vacation and I was taking care of the business while he was gone. Which also meant driving his truck, which is an ill-handling bitch that I have a distinct hatred for. I'd only been driving it for a short while, I'd gone from a 2002 Sunfire to that, the Sunfire handled just a touch better...I was still getting used to the POS when I got nailed. Still, I did nothing unsafe, in fact I was fully anticipating the yellow light by looking at the crosswalk signals (something they taught me in driver training, another thing they taught me was the "point of no return", which I was at when I made the decision to go through the yellow light). There is no difficulty determining what light colour I went through...even my sister, who has an extremely meek temperament, told him straight up that he was basically lying when he tried telling me I ran a red. That light was as yellow as it gets. I didn't see even a blink of red. In fact I'm thinking I should take my sis, witness surely won't hurt. Matt, I'm thinking it would be a bad idea to bring info on my dads truck, since I have a hunch it's rather overloaded. He's cheap and the truck (96 Dakota V6) still runs, and he hates gas guzzlers...so that's what he has and that's what I was forced to drive. But the judge won't give a shit, they never do, you're somebody else and of course you always have some sort of option even if you actually didn't. I'm not sure how weather conditions would help either...they'll try and say that speed limit is too fast in the rain, of course we all know that's a crock too but in the courtroom it's all about technicalities, not justice. Any other ideas, maybe some loopholes and such I should know about?

in your opinion, but what i am saying make sence. He should have stopped for a yellow light especially if there was a cop watching, I also don't see the sence in fighting it, it seems senceless to do so. Just accept it and move on.

They teach u in driver training courses that if it is not safe to come to a complete stop before the thred than go thru the yellow. They also stated to me that if someone is following too close behind u then it also is cause for u to run thru a Yellow light. Obviously u don't want to be doin this thru a stale yellow but if it was just regualr yellow i would dispute it.
Tell the Judge there was somone following very close behind u that u could barely see out ur side view mirrors in your Dads big work truck. It was wet and i felt the safest thing to do at the time for both me and others around was to to proceed thru the yellow. State u glanced left to right before entering the intersection and made for certain there were no hazards to warrant a risky and emergcy stop at the yellow light.

Well, my day in court came and went. Prick didn't even show up, I guess that was good for me but it still cost me half a days pay. I wasn't the only one there with a ticket from him either, I guess officer baldinger has been busy handing out bullshit tickets. Doesn't seem too eager to back them up in the courtroom though...

I'm pretty sure...I had a hunch he wouldn't show, but I figured I had to go anyways. If they didn't put in a guilty plea, they'd probably postpone it and there's no point taking the chance he'll show next time. Either way I'd have to lose some money, but a few hours lost wages still cost me less than the ticket. Besides, I actually didn't mind taking some time off today, I went dirtbiking on the weekend and bailed like I've never bailed before so I'm a little sore still.

Generally, when neither the officer nor the accused show up, the accused is deemed to have pled guilty.

in case you didnt know, the reason other people with tickets from the same officer are there is because its organized that way, anyone who disputes with that officer gets put on a set aside day in which the officer spends in court.

When you don't show up at your trial, you are deemed to have decided to plead guilty. If you show up, you are still innocent.

Pretty soon we would have a schedule that contained only reschedules and likely no one would be showing up then either.
We could go back to the old way, where you paid $25 to initiate a dispute, and if you showed up, you got the $25 back, win or lose.

To some extent, until we run into the driver who can't afford to tie up $25 for the dispute. This isn't out of the question either.
